Welcome to ZipTrips.AI (“ZipTrips,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of the ZipTrips.AI mobile application (the “App”) on iOS and Android devices and any related services (collectively, the “Services”).

By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old to use the Services. By using the App, you represent and warrant that you meet this requirement.

2. Nature of Services

ZipTrips.AI provides AI-powered travel recommendations and related informational tools. The Services are provided for general informational purposes only. We do not guarantee accuracy, availability, pricing, or suitability of any travel recommendations.

3. Payments and Third-Party Processing

All payments, subscriptions, or financial transactions made through the App are processed exclusively by Stripe, Inc. or its affiliates (“Stripe”).

ZipTrips.AI:

• Does not store, process, or have access to your full payment card details.
• Does not collect or retain payment-related personally identifiable information (PII).

All payment processing, financial data handling, and related personal information are governed by Stripe’s Terms of Service and Privacy Policy, which you agree to when completing a transaction.

ZipTrips.AI is not responsible for Stripe’s services, policies, or security practices.

4. No Collection of Personal Identifiable Information (PII)

ZipTrips.AI is designed to operate without collecting personally identifiable information.

• We do not collect, store, or sell personal data such as full name, home address, social security number, or payment card data.
• We strongly discourage users from entering personal information into profile fields, prompts, chat inputs, or other areas of the App.
• Any personal information voluntarily submitted by users is done at their own discretion and risk.

Users are solely responsible for the content they submit within the App.

5. User Content and Conduct

You agree not to:

• Upload or transmit personal sensitive information.
• Violate any applicable laws or regulations.
• Use the Services for fraudulent or unlawful purposes.
• Attempt to gain unauthorized access to the App or related systems.

We reserve the right to suspend or terminate access for violations of these Terms.

6. Intellectual Property

All content, software, AI models, algorithms, branding, logos, design elements, and technology within the App are the exclusive property of ZipTrips.AI or its licensors and are protected by intellectual property laws.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App.
• Reverse engineer, decompile, disassemble, or attempt to extract source code.
• Embed, frame, mirror, or incorporate the App or its components into any other software, platform, or service without prior written consent from ZipTrips.AI.
• Use automated systems (bots, scrapers, crawlers) to access or extract data.

Unauthorized use may result in legal action.

7. Disclaimer of Warranties

The Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted, error-free, or secure operation of the App.

8. Limitation of Liability

To the maximum extent permitted by law, ZipTrips.AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.

Our total liability shall not exceed the amount paid by you (if any) to ZipTrips.AI in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless ZipTrips.AI, its officers, directors, affiliates, and employees from any claims, damages, liabilities, or expenses arising from your misuse of the Services or violation of these Terms.

10. Modifications

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
